لا شك أن التطور التكنولوجي في ذلك العصر قد ألقى بظلاله على العقود, فأصبحت تبرم بطرق غير تقليدية, توفر عنصر السرعة في إتمام العقود, ودون التقاء طرفي العقد جسديا, ومع تقدم أسلوب الحياة المعاصرة, أفرزت لنا التكنولوجيا وسائل اتصال حديثة ومتنوعة يمكن الحديث من خلالها بطرق مختلفة بين الناس, حتى وصل الأمر ببعض الشباب الخطبة والزواج عن طريق تلك الوسائل الحديثة, و قد يترتب عليه الخلوة بمخطوبته, وبزوجته المعقود عليها, فكان لزاما على المختصين بالعلوم الشرعية بحث تلك المستجدات المعاصرة, وضبطها؛ لذا حاولت في هذا البحث بيان الخلوة الحقيقية, وشروطها, وكيفية إثباتها, والصور المعاصرة لها, ثم بينت مفهوم الخلوة المعنوية, وبيان الحكم الفقهي لها, وآثارها فيما بين المخطوبين والزوجين, مبينا أثرها على المخطوبين في الهدايا, و إزالة البكارة بتلك الخلوة إذا انتشت أثناء تلك الخلوة, وتسجيل المحادثات بينهما, وأثرها على المعقود عليها في إزالة بكارتها إذا انتشت أثناء الخلوة المعنوية, وكمال المهر, وثبوت العدة, والنسب, والرجعة, وحرمة المصاهرة, ووجوب النفقة, وتسجيل تلك المحادثات بينهما ومشاهدتها, وذلك في إطار فقهي متزن ؛ ليكون الناس على بصيرة من أمرهم , وعلى هدي من كتاب ربهم وسنة نبيهم محمد - صلى الله عليه وسلم- مستعينا بالله, وراجيا منه التوفيق والعون.
Abstract:
There is no doubt that the technological development in that era has cast a shadow over the contracts, as they have become concluded in non-traditional ways, providing an element of speed in completing the contracts, and without the parties to the contract meeting physically, and with the progress of the contemporary lifestyle, technology has provided us with modern and diverse means of communication through which we can talk In different ways among people, until it came to some young men to get engaged and get married through these modern means, and it may result in being alone with his fiancée and his married wife, so it was necessary for specialists in legal sciences to research these contemporary developments and control them. So, in this research, I tried to explain the true solitude, its conditions, how to prove it, and contemporary images of it, then I explained the concept of moral solitude, and the statement of the jurisprudential ruling on it, and its effects among the betrothed and the spouses, indicating its impact on the betrothed in the gifts, and the removal of the virginity by that solitude if it broke during That being alone, recording the conversations between them, and its impact on the woman contracted in removing her virginity if she erupted during spiritual solitude, the perfection of the dowry, the proof of the waiting period, lineage, taking back, the sanctity of affinity, the obligation of alimony, and the recording of those conversations between them and witnessing them, in a balanced jurisprudential framework; So that people are aware of their affairs, and upon guidance from the Book of their Lord and the Sunnah of their Prophet Muhammad - may God’s prayers and peace be upon him - seeking help from God, and hoping for success and help from Him.
