قامت الشريعة الغراء بمراعاة كل ما من شأنه أن يحفظ الأسرة، ويعمل على استقرارها، فأعطت كل واحدٍ من الزوجين الحق في طلب التفريق، وفك الرابطة الزوجية بينه، وبين شريك حياته متى ظهر به عيبٌ لا يمكن أن تستمر معه الحياة إلا بضرر.
ومع الوقت ظهرت بعض السلوكيات المذمومة، التي لا تَضُرُ بصاحبها فقط بل تتعداه لغيره، ومن هذه السلوكيات: إدمان المخدرات الذي انتشر بصورةٍ لافتةٍ للنظر في هذه الأيام، فكثرت المشكلات بين الزوجين، واعتدى الزوج المدمن على زوجته بصنوفٍ من الاعتداءات حتى وصل الأمر إلى القتل، ونظرًا لخطورة هذه المشكلة آثرت أن أسهم في معالجة هذه المشكلة، فجعلت بحثي بعنوان: إدمان المخدرات، وأثره في الفُرْقَةِ بين الزوجين دراسة فقهية مقارنة بقانون الأحوال الشخصية المصري، فقسمت البحث إلى مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة، وفهارس علمية، أما المقدمة: فقد تناولت فيها الحديث عن أهمية الموضوع، وأسباب اختياره، وأهدافه، والدراسات السابقة فيه، ومنهج البحث، وخطته.
وأما التمهيد: فاشتمل على التعريف بمفردات العنوان، وأما المبحث الأول فجاء بعنوان: أنواع المخدرات، وأسباب إدمانها، وحكمها الشرعي، وأما المبحث الثاني فجاء بعنوان: مدى ثبوت الفرقة بين الزوجين بعيب أحدهما، وأما المبحث الثالث: ففي حكم التفريق بين الزوجين لإدمان المخدرات، ومسوغه، وضوابطه، وأما الخاتمة: فقد ضمنتها أهم النتائج، والتوصيات التي توصلت إليها من خلال البحث، ثم ذيلت البحث بفهارسَ علميةٍ؛ للدلالة على محتواه بسهولةٍ ويسرٍ.
The Sharia has taken into account everything that would preserve the family and stabilize it, giving each of the spouses the right to request separation and the dissolution of the marital bond between him and his life partner whenever a defect appears in him that life can only continue with damage.
With time, some reprehensible behaviors have appeared, which do not harm their owner only, but also exceed others, and these behaviors include: drug addiction, which has spread remarkably these days, so problems abound between spouses, and the addicted husband assaulted his wife with types of assaults until it came to murder, and due to the seriousness of this problem, I chose to contribute to addressing this problem, so I made my research entitled: Drug addiction, and its impact on the separation between spouses, a jurisprudential study compared to the Egyptian Personal Status Law, divided the research into an introduction, a preface, three sections, a conclusion, and scientific indexes, while the introduction: it dealt with talking about the importance of the subject, the reasons for its choice, its objectives, previous studies in it, research methodology, and its plan.
-The introduction: included the definition of the vocabulary of the title, and the first section came entitled: types of drugs, and the causes of addiction, and the rule of legitimacy, and the second section came entitled: the extent to which the difference between spouses is proven defective one of them, and the third section: in the rule of differentiation between spouses for drug addiction, and its justification, and controls, and the conclusion: has included the most important results, and recommendations reached through research, and then removed the search scientific indexes; to indicate its content easily and easily.
