تناولت هذه الدراسة موضوع "حقوق الأطفال المهاجرين في حالة السلم بوصفه من أبرز القضايا الإنسانية والقانونية التي شغلت اهتمام المجتمع الدولي، لا سيما مع تزايد أعداد الأطفال المهاجرين، خصوصًا أولئك غير المصحوبين بذويهم.
وقد سعت الدراسة إلى استعراض الإطار القانوني الدولي الذي نظم حماية هذه الفئة، مركزةً على فعالية الآليات القانونية المنصوص عليها في الاتفاقيات الدولية، وفي مقدمتها: اتفاقية حقوق الطفل لعام 1989، واتفاقية اللاجئين لعام 1951، والاتفاق الدولي لحماية حقوق جميع العمال المهاجرين وأفراد أسرهم لعام 1990، بالإضافة إلى الاتفاق العالمي من أجل الهجرة الآمنة والمنظمة لعام 2018.
واعتمد الباحث في منهجيته على المنهج الاستقرائي التحليلي، من خلال استقراء النصوص القانونية الدولية وتحليل مضامينها، وعلى المنهج الوصفي لرصد الواقع العملي الذي يعيشه الأطفال المهاجرون في دول العبور والاستقبال، مبرزًا أوجه القصور والتحديات التي تعوق تمتعهم الكامل بحقوقهم الأساسية.
وقد بيّنت الدراسة أن حماية الأطفال المهاجرين لا تزال تواجه فجوات تشريعية وتنفيذية، تمثلت في ضعف مواءمة التشريعات الوطنية مع الالتزامات الدولية، وتراجع مبدأ "المصلحة الفضلى للطفل" في ممارسات الدول، إلى جانب استمرار مظاهر التمييز والاستغلال. وخلصت الدراسة إلى توصيات عدة، من أبرزها: ضرورة تعديل السياسات الداخلية للدول بما يتوافق مع المعايير الدولية، وتفعيل آليات الرقابة الأممية، وضمان تمكين الأطفال المهاجرين من حقوقهم في التعليم والرعاية الصحية والحماية من العنف، بما يسهم في صون كرامتهم وتحقيق العدالة لهم.
 
This study addressed the topic of “Rights of Migrant Children in Times of Peace” as one of the most prominent humanitarian and legal issues that has captured the attention of the international community, especially with the growing numbers of migrant children, particularly those unaccompanied by their parents. The study aimed to examine the international legal framework that governs the protection of this vulnerable group, focusing on the effectiveness of the legal mechanisms set out in international conventions, most notably: the Convention on the Rights of the Child (1989), the Refugee Convention (1951), the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (1990), and the Global Compact for Safe, Orderly and Regular Migration (2018).
The researcher adopted an inductive-analytical approach by reviewing and analyzing relevant international legal texts, along with a descriptive method to observe the practical realities faced by migrant children in transit and host countries, highlighting the shortcomings and challenges that hinder their full enjoyment of basic rights.
The study revealed that the protection of migrant children still faces legislative and procedural gaps, represented by the lack of alignment between national laws and international obligations, the decline in the application of the "best interests of the child" principle in state practices, and the persistence of discrimination and exploitation. The study concluded with several recommendations, most notably: the need to amend national policies to align with international standards, activate international monitoring mechanisms, and ensure that migrant children have access to education, healthcare, and protection from violence, thereby safeguarding their dignity and achieving justice for them.
