جاء هذا البحث لتوضيح آراء الفقهاء في مسألة تعدد الزوجات والعدل بينهن في القسم لإبراز الرؤية الإسلامية للمرأة وتوضيح علو مكانتها في الشريعة الإسلامية. وقد اشتمل هذا البحث على مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة. أما المقدمة فتحتوي على أسباب اختيار البحث، وأهدافه، وأهميته، والدراسات السابقة، ومنهج البحث، وإجراءاته، وخطته. والتمهيد جعلته في التعريف بالمصطلحات الواردة في عنوان البحث، والمبحث الأول: تعدد الزوجات في الشريعة الإسلامية، ويتضمن ثلاثة مطالب: المطلب الأول: مشروعية تعدد الزوجات وحكمه، والمطلب الثاني: أسباب تعدد الزوجات، والمطلب الثالث: ضوابط التعدد في الشريعة الإسلامية. والمبحث الثاني: مسألة الخلاف في القَسْم للبكر والثيب، ويتضمن أربعة مطالب: المطلب الأول: في القول الأول في مسألة القَسْم للبكر والثيب، وأدلتهم، والمطلب الثاني: في القول الثاني في مسألة القَسْم للبكر والثيب وأدلتهم، والمطلب الثالث: مناقشة القول الأول لأدلة القول الثاني، والمطلب الرابع: في القول المختار، وسببه والمبحث الثالث: مسألة الخلاف في القسم في السفر، ويتضمن ثلاثة مطالب: المطلب الأول: في القول الأول في مسألة القسم في السفر، وأدلتهم، والمطلب الثاني: في القول الثاني في مسألة القسم في السفر، وأدلتهم، والمطلب الثالث: في القول المختار، وسببه، وأما الخاتمة: فتشتمل على أهم النتائج، ثم قائمة المصادر والمراجع. وقد اعتمد البحث على المنهج الاستقرائي، والمنهج التحليلي والاستنباطي. وقد توصل البحث إلى نتائج أهمها: إثبات أهمية التشريع الإسلامي الخاص بإباحة تعدد الزوجات لما فيه من فوائد عظيمة على مستوى الفرد والمجتمع في الأمة الإسلامية، وأن المفهوم الشرعي للقسم بين الزوجات هو المبيت عندهن للصحبة والمؤانسة لا في المجامعة والمحبة، ومشروعيته ثابتة في الكتاب والسنة والإجماع، كما وضع الشرع الحنيف ضوابط دقيقة لنظام القسم وهي تمثل الأسس التي لابد منها لكي يستقيم البيت المسلم ويتجنب المخاطر والمزالق عند التطبيق، كما تترتب على مشروعية القسم بين الزوجات أحكام مختلفة بصفة الوجوب أو الندب أو التحريم أو الإباحة، لأن في مراعاتها تسديداً للخطوات وإزاحة للغشاوة التي افتعلها أعداء المسلمين للطعن بهذا الدين والتآمر على استقرار حياة المسلمين.
This current research came to clarify the views of jurists on the issue of polygamy and justice between them in the section to highlight the Islamic vision of women and clarify their high status in Islamic law. This research included an introduction, a preface, three chapters, and a conclusion. The introduction contains the reasons for choosing the research, its objectives, its importance, previous studies, the research methodology, its procedures, and its plan. And the preface. The first chapter: Polygamy in Islamic law, and includes three demands: The first demand: The legitimacy of polygamy and its ruling, the second demand: The reasons for polygamy, and the third demand: The controls of polygamy in Islamic law. The second section: The issue of disagreement over the division of time for virgins and previously married women, and includes three topics: The first topic: Al-Shafi'i's opinion on the division of time for virgins and previously married women and his evidence, The second topic: The opinion of the opponents and their evidence, and the third topic: Imam Al-Shafi'i's discussion of the opponents. The third topic: The issue of disagreement over the division during travel, and includes two topics: The first topic: Imam Al-Shafi'i's opinion on the issue and his evidence, and the second topic: The opinion of the opponents and their evidence. As for the conclusion, it includes the most important results, then a list of sources and references. The research relied on the inductive method, the analytical method, and the deductive method. The research reached the most important results: proving the importance of Islamic legislation regarding the permissibility of polygamy for its great benefits on the individual and societal levels in the Islamic nation, and that the legal concept of division among wives is spending the night with them for companionship and sociability, not for sexual intercourse and love, and its legitimacy is established in the Qur’an, Sunnah and consensus, as the Noble Sharia has set precise controls for the division system, which represent the foundations that are necessary for the Muslim home to be straight and avoid risks and pitfalls when applied, as well as the legitimacy of division among wives entails different rulings in the form of obligation, recommendation, prohibition or permissibility, because observing them corrects the steps and removes the veil that the enemies of Muslims have created to challenge this religion and conspire against the stability of Muslims’ lives.
