This article comprehensively analyses mechanisms provided for in the bankruptcy law of Saudi Arabia and United Kingdom for financial restructuring. The purpose is to answer how the respective frameworks deal with corporate financial distress. The United Kingdom system presents a variety of alternatives for restructuring; hence, corporations get to negotiate and sort out their businesses while keeping the provisions of the law upon them. These options include contractual and consensual mechanisms, which provide oversight and guidance through the entire process. On the other hand, Saudi Arabia revamped its insolvency regime through the Saudi Arabia Bankruptcy Law of 2018 issued for practices at par with international standards and in line with the aspirations of Vision 2030. This act brought modern mechanisms like financial reorganization and preventive settlement for the recovery of its debtors with protective measures to treat its creditors with equality. This study evaluates this process and its impacts, with further explanations of developments in insolvency regimes in Saudi.
 
تقدم هذه المقالة تحليلاً شاملاً للآليات المنصوص عليها في قانون (نظام) الإفلاس لكل من المملكة العربية السعودية والمملكة المتحدة، والمتعلقة بإعادة التنظيم المالي. كما تهدف إلى استكشاف كيفية تعامل الأطر القانونية في كل من النظامين مع حالات الضائقة المالية التي تواجهها الشركات.
يتميز النظام القانوني في المملكة المتحدة بتوفير مجموعة واسعة من البدائل لإعادة الهيكلة، مما يمنح الشركات فرصة للتفاوض وإعادة تنظيم أعمالها ضمن الأطر القانونية المحددة. وتشمل هذه الخيارات آليات تعاقدية وتوافقية توفر الإشراف والتوجيه طوال العملية. أما في المملكة العربية السعودية، فقد شهد نظام الإفلاس إصلاحات جوهرية بموجب نظام الإفلاس السعودي الصادر عام 2018، والذي صُمم لمواءمة الممارسات المحلية مع المعايير الدولية وتحقيق أهداف رؤية 2030. وقد استحدث هذا النظام آليات حديثة، بهدف تمكين المدينين من استعادة استقرارهم المالي، مع توفير ضمانات تكفل حماية حقوق الدائنين وتحقيق المساواة بينهم.
تسعى هذه الدراسة إلى تقييم هذه الآليات وتأثيرها، مع تقديم تحليل معمّق للتطورات التي شهدها نظام الإفلاس في المملكة العربية السعودية.
