هذه بحث في الفروق الفقهية التي اهتم بها جمعٌ من العلماء، وهي: «إبراز التمايز بين مسألتين فقهيتين أو بين حقيقتين»، جمعتُ في هذا البحث فروقًا فقهية للإمام ابن حزم رحمه الله في كتابه المحلى، وقد قصرتُه على الفروق التي قوَّاها ابن حزم، وكان ذلك بجمعها أولًا، ثم الاستدلال لها ثانيًا، مع شرح الغريب من ألفاظها، وتخريج الأحاديث الواردة فيها.
وقد رتبتُ هذه الفروق تحت مطالب تسعة، يندرج تحت كل مطلب فرعانِ أو أكثر، وبدأت بـ:
1- مطلب الفروق الفقهية التي قوَّاها ابن حزم في كتاب الطهارة، وفيه فروع: بول الذكر والأنثى، ولسان الكلب وأعضائه، ووقوع الفأرة في السمن وغيره، وغسل الرجلين ومسح الخفين.
2- ثم الصلاة، وفيه: سهو الكلام وعمده، وجلوس المرأة واضطجاعها بين المصلي، والصلاة في غير سبيل الحق والمسافر معصيةً، والنسيان في الصلاة والصوم والذبيحة.
3- ثم الزكاة، وفيه: المسكين والفقير، وحكم المائة وعشرين من الإبل وما زاد.
4- ثم الصيام، وفيه: من أفطر ويرى أنه ليل فطلعت الشمس ومن أكل شاكًّا في الفجر، وصيام الدهر وسرد الصوم.
5- ثم الحج، وفيه: ضمان الأموال في الإحرام، وكفارة الصيد في الصوم وقتل النفس خطأ في غير صوم.
6- ويليها مطلب الأطعمة والصيد، وفيه: الشيء وبين ما تولد منه ولم يقع عليه اسم ما تولد منه، والكلب المعلم وغيره، وخلط التمر والزبيب في الإناء والبطن.
7- فالبيوع، وفيه: بيع شيء من الغائبات، والبيع والربا، والبيع والسلم والقرض، والضمان والأداء في العارية، والغاصب والمستحق في لحوق الولد.
8- فالقضاء والجنايات والحدود، وفيه: تسعة فروع.
9- فالنكاح والطلاق، وقد قدمتُ أمام المقصود بمقدمة وتمهيد، وختمتُ البحث بأبرز النتائج وأهم التوصيات.
Abstract:
This is a research on the jurisprudential differences that a large number of scholars are interested in, that is “highlighting the distinction between two jurisprudential issues or between two facts”. In this research, I collected some of the jurisprudential differences of Imam Ibn Hazm (may God have mercy upon him) in his Al-Mahla. Through collecting and investigating them I also confined the research to the differences that have been given a firm foundation by Ibn Hazm, by collecting and conducting them, and explaining the unfamiliar terms and referencing the traditions (hadiths) mentioned in them.
I have organized these differences under nine postulates, with two or more subdivisions for each. I started my organization with the following:
The jurisprudential differences that have been given a firm foundation by Ibn Hazm in the Book of Purity (Taharah). This postulate has the following subdivisions: Male and female urine, the dog's tongue and organs, the mouse falling into ghee and others, washing the feet and wiping the footwears.
It includes forgetfulness and intention of speech, a woman sitting and lying down among the worshipers, praying in a manner other than the truth, the traveler for the sake of sin, and forgetfulness in prayer, fasting, and the slaughtered animal (Thabieha).
Zakat, which contains: the poor and the needy person, and the Islamic rule about the five hundred camels and more.
Fasting, and it contains: the one who breaks his/her fasting thinking that this happens during the night, then the sun rises, the one who eats while doubting the time of dawn, the eternal fasting, and observing fasting for several days without Iftar (Sard Al-Sawm).
The Pilgrimage (Al-Hajj), this includes: guarantee of money during Ihram, expiation for hunting during fasting, and mistaken sleeping during non-fasting.
Foods and hunting. This postulate contains: something between what is generated from itself and does not fall under the name of what is generated from it, the trained dog and others, and mixing dates and raisins in the vessel and stomach.
Trades, and they include: the sale of something that is not invisible and available, trade and usury, trade, peace and loan, loan guarantee and payment, and the plunderer and the person entitled to the rights of the child.
Judiciary, crimes and punishments (Hodoud), including nine paths.
Marriage and divorce.
Finally, I presented the research with a preface and introduction, and concluded with the most prominent and important results.
