بداية لا بد أن نبين أنه ليس هناك تعريف محدود، ولا نوع معين للإنسآلة، وهي في تطور التطور كل يوم، بل كل دقيقة، لجعل حياتنا أكثر أمانًا وسلامة، لكن لكل شيء ثمن، وثمن هذه الأشياء الذكية من شأنها إحداث مجموعة من الأخطاء والأضرار الناتجة عن العيوب أحيانًا، ولها مجموعة من الآثار القانونية المترتبة على ذلك.وقد اشتملت هذه الدراسة على مفهوم الإنسآلة، وبينت الشخصية القانونية لها ومدى قدرتها على التعاقد، كما أوضحت الدراسة أساس المسئولية المدنية عن أضرار الإنسآلة، سواء أكانت على أساس فكرة الحراسة، أو على أساس المتبوع عن أفعال تابعه، أو وفقًا للنظريات الحديثة التي تقوم على فكرة الوكالة أو على أساس نظرية النائب الإنساني.كما تضمنت الدراسة الأثر المترتب على تحقق المسئولية المدنية عن أضرار الربوت، ومنها التعويض، وكذلك دفع المسئولية المدنية الناشئة عن أضرار الإنسآلة. ثم اختتمت الدراسة بخاتمة اشتملت على بعض النتائج المستوحاة منها، وكذلك بعض التوصيات المقترحة في شأن هذا الموضوع.
 
Abstract :
The concept of robotics is continually evolving, with no specific or limited definition. It encompasses various intelligent technologies designed to enhance safety and security in our daily lives. However, the benefits of these smart technologies come at a cost, and the potential for errors and damages due to flaws exists, leading to legal consequences. This study explores the legal aspects of robotics, focusing on the concept of "ensoulment."The research delves into the legal personality of robotics and its contractual capacity. It elucidates the foundational principles of civil liability for robotic damages, whether based on the concept of custody, actions of the entity controlling the robot, or modern theories such as agency and the theory of human substitute.Furthermore, the study examines the consequences of establishing civil liability for robot damages, including compensation and the payment of civil liability arising from ensoulment-related harms.In conclusion, the study presents key findings and recommendations derived from the research, shedding light on the legal implications and responsibilities associated with robotics.
