المحاماة لتحقيق سير العدالة The Lawyer For Achieving Justice

يتركز البحث حول المحاماة كما يجب ان تكون :
يتناول هذا البحث موضوع على قدر كبير من الأهمية إلا أنه يبرز مسئولية المحامي كأحد الأعمدة الأساسية لتحقيق العدالة لضمان الحقوق والحريات والحماية من التجاوزات ، ويقوم على احترام القوانين وتعد هذه المهام من مقومات الدولة الحديثة ومرتكز من مرتكزات البناء الديمقراطي .
ويبين أيضا رسالة القضاء مع رسالة المحاماة التي لا يمكن لها أن ترى النور إلا بوجود قاضي يستشعر الرسالة السامية التي يحملها والتي تتطلب منه أن يتصف بصفات معينة لتكوين شخصية سوية لا ميل فيها ولا هوى .
ونظرا لخطورة مهامه يتطلب له حصانة تحميه من كل ما من شأنها المساس بهم .
 ويسلط الضوء على القاضي والمحامي لإحقاق الحق وهذا لا يتحقق إلا بتوفير الحصانة اللازمة له وتوفير وسائل مساعدة وذلك أن القاضي حتى يصل إلى الحقيقة التي يبحث عنها بين ثنايا القضايا المطروحة عليه ، يحتاج إلى من يساعده ويعاونه ويتيسر له الطريق ليفصل في النزاع وهذا الشخص هو المحامي .
ولا غرابة إذا قلنا أن عمل المحامي أصعب من عمل القاضي لأن عمل المحامي هو البحث عن الدليل وتقدمه إلى القاضي للفصل على ضوئه في ضوء هذه الاعتبارات فإن المحامي لكي يقوم بدوره لكشف التحقيق والبحث عنها لابد من توافر عدة شروط ...
وسوف نعرض للمحاماة من وجهة نظر الشريعة الإسلامية والقوانين المعاصرة .

And the judge and the lawyer were highlighted to achieve the right and this can only be achieved by providing the necessary immunity for him and providing means of assistance, and that the judge until he reaches the truth he searches for between the cases before him, he needs someone to help him and help him and has the way for him to resolve the dispute and this person is the lawyer .
