ضوابط الاستدلال بالسنة النبوية "دراسة أصولية تطبيقية" / Regulations Of Inference Based On The Sunnah Of The Prophet, An Applied Fundamentalist Study

 إن السنة النبوية المشرفة هي المصدر الثاني للتشريع، وهي البيان النبوي للقرآن الكريم، وإن العمل بها فريضة دينية، ولا يمكن أن يستغني عنها مسلم.
لكن العمل بالسنة والاستدلال بها يجب أن يكون وفق مجموعة من الضوابط العلمية، وإن بيان هذه الضوابط يعد من أكثر الدراسات الأصولية أهمية وضرورة؛ لأن العمل بالسنة والاستدلال بها بدون مراعاة هذه الضوابط يؤدي إلى سوء استعمالها، أو وضعها في غير موضعها، أو غياب مقاصدها وثمراتها.
وهذا البحث يتناول بالدراسة مجموعة من الضوابط العلمية التي يجب مراعاتها عند العمل بالسنة أو الاستدلال بها، مع ذكر نماذج تطبيقية على هذه الضوابط.
 وأهم النتائج التي انتهت إليها هذه الدراسة هي أن التعامل مع السنة النبوية استدلالا وتطبيقا يجب أن يكون في ضوء الضوابط العلمية، ومن هذه الضوابط: تحديد الصفة التي صدر عنها الحديث، تحديد مقتضى الأمر أو النهي، مراعاة أسباب ورود الحديث، فهم الحديث في ضوء القواعد العامة والنصوص الكلية للشريعة، التمييز بين الأحاديث العامة، والأحاديث المبنية على أحوال وظروف خاصة.
 
Abstract:
The honorable Sunnah of the Prophet is the second source of legislation, and it is the prophetic statement of the Holy Qur’an. Acting upon it is a religious obligation, and no Muslim can do without it.
However, acting according to the Sunnah and using it as evidence must be in accordance with a set of scientific rules, and clarifying these rules is considered one of the most important and necessary fundamentalist studies. Because acting on the Sunnah and relying on it without paying attention to these rules leads to its misuse, misuse, or absence of its goals and fruits.This research examines a set of scientific rules that must be taken into account when working with the Sunnah or using it as evidence, while mentioning applied examples of these rules.
 The most important findings of this study are that working on the Prophet’s Sunnah as evidence and application must take into account the following scientific controls: identifying the characteristic from which the hadith departed, determining the purpose of the command or prohibition, taking care of the reasons for saying the hadith, understanding the hadith through the general rules and comprehensive texts of Islamic law, Distinguishing between general hadiths and hadiths based on special conditions and circumstances.
