  لا شك أن قضية مكافحة الفساد الإداري تُعد من أهم القضايا المعقدة على الصعيد الداخلي لأي دولة وذلك من خلال عدم قيام جهة الإدارة أو القائمين عليها بتطبيق القانون بالشكل الصحيح أو الجهل به في أحيان أخرى، كما أن عدم إفصاح جهة الإدارة عن الإجراءات أو الأسباب التي أدت إلى صدور بعض القرارات التي ليس لها طابع سري تؤدي إلى عدم تطبيق مبدأ الشفافية بحيث لا تسمح لأصحاب الشأن الحصول على المعلومات الضرورية التي تتعلق بمصالحهم وشؤونهم الوظيفية.
كما أن انحراف جهة الإدارة أو القائمين عليها عن مبدأ المشروعية أو مخالفة القانون يؤدي إلى وجود فساد إداري ومالي، فقد حدد المشرع قوانين وقرارات ولوائح تنظيمية تسير عليها جهة الإدارة والموظفين والأفراد أيضاً، وأي انحراف أو عدم تطبيق لهذه القوانين والقرارات تؤدي إلى وجود مخالفة إدارية أو مالية يُسأل عنها مرتكبها وينال عقابه وفقاً للقانون.
أهداف البحث:
يهدف هذا البحث إلى دراسة دور الأجهزة الرقابية في إلزام جهة الإدارة بتطبيق مبدأ المشروعية للحد من  الفساد الإداري، ودراسة أهم السبل الكفيلة لمكافحة هذا الفساد، كما يهدف هذا البحث إلى تسليط الضوء حول اختصاصات هذه الأجهزة وكذلك ضرورة قيام الحكومة بالرقابة الذاتية للجهات التابعة لها والخاضعة لإشرافها للحد من الفساد الإداري والأثار الناجمة عنه.
كما يهدف هذا البحث إلى إيجاد سبل وطرق من شأنها أن تحد من ظاهرة الفساد الإداري واحترام مبدأ سيادة القانون.
 
Abstract:
There is no doubt that the issue of combating the administrative corruption is considered one of the most important complex issues at the internal level of any country. This is due to the failure of the administration or those in charge of it to implement the law in the correct manner or ignorance of it at other times, and also the failure of the administration to disclose the procedures or reasons that It led to the issuance of some decisions that were not confidential, leading to non-application of the principle of transparency in a way that did not allow stakeholders to obtain the necessary information related to their interests and employment affairs.
Also, the deviation of the administration or those in charge of it from the principle of legality or violation of the law leads to the presence of administrative and financial corruption. The legislator has specified laws, decisions, and regulations that the administration, employees, and individuals must also follow. Any deviation or non-application of these laws and decisions leads to an administrative violation. Or financial, for which the perpetrator will be held accountable and punished according to the law.
Research objectives
This research aims to study the role of regulatory agencies in obliging the administration to implement the principle of legality to reduce administrative corruption, and to study the most important ways to combat this corruption. This research also aims to shed light on the competencies of these agencies, as well as the necessity for the government to self-monitor the agencies affiliated with it and subject to it. For its supervision to reduce administrative corruption and its resulting effects.
This research also aims to find ways and methods that would limit the phenomenon of administrative corruption and respect the principle of the rule of law.
