التّشريعات البيئيّة الحديثة في المملكة العربيّة السُّعوديّة / Modern Environmental Legislation In The Kingdom Of Saudi Arabia

يتناولُ هذا البحث التشريعات البيئية الحديثة في المملكة العربية السعودية، ونهج الباحث فيه المنهج الاستقرائي، حيثُ قام بتتبُّعِ تلك التشريعات المبثوثة والمتعددة وحصرها. وتنبعُ أهميّة البحث من أهمية حماية البيئة وضرورة تكثيف الجهود في الحفاظ عليها. كما تكمن مشكلة البحث في الحاجة إلى إبراز جهود المملكة التشريعية ودورها، باعتبارها من أكبر منتجي النفط، وعضوًا بارزًا في أسواق الطاقة، وما يُثار من مزاعم حول إضرار تلك الدول بالبيئة وعدم بذل عنايتها الكافية في ذلك. كذلك فإنّ تعدُّد تلك التشريعات يستوجب البحث عن الأوجه التي قد تؤدّي إلى ازدواجية أو تداخل بينها، ومعالجتها - إن وجدت- ويهدفُ هذا البحث إلى تسليط الضوء على التشريعات الحديثة في الملكة العربية السعودية في مجال حماية البيئة، وجمعها في إطار واحد، توثيقًا لها، وتسهيلًا على الباحثين في هذا المجال. وتم تقسيم البحث إلى مقدمة ومبحثين وخاتمة. خلص الباحث إلى نتائج رئيسية، منها: عناية المملكة واهتمامها البالغ بالبيئة، واعتبارها أولوية قصوى، ضمن رؤية المملكة 2030. وتنوع تلك الجهود لتشمل كافّة أشكال وعناصر البيئة، محليًّا وإقليميًّا ودوليًّا، وجسد ذلك من خلال ركائز رئيسية هي: الإدارية والقانونية والمالية والأمنية لضمان الاستدامة والفاعلية. وجاءت أبرز التوصيات بإنشاء برامج لتأهيل وتدريب المهتمّين بالعمل في المجال البيئي، وإنشاء منصّة وطنية لتوثيق جهود المملكة في المجال البيئي، وتسهيلًا للباحثين.
 
Abstract:
 
This study aims to review the efforts and role of the Kingdom in protecting the environment. The researcher's approach in this study is the inductive method, as he traced and counted those various and numerous efforts. The importance of the study stems from the importance of protecting the environment and the need to intensify the efforts to preserve it. The issue of the study lies in the need to highlight the efforts of the Kingdom and its role, as one of the largest oil producers, and a prominent member of the energy markets, and addressing the allegations against those countries in regard to the damage to the environment and lack of sufficient care for the environment. Also, the multiplicity of these efforts requires searching for any aspects that may lead to duplication or overlapping between them, and the necessity to address them, if any. This study aims to shed light on the Kingdom's efforts in the field of environmental protection, and to list them in one or more frameworks, to document them and to facilitate the research in this field. The study was divided into an introduction, two sections and a conclusion. The researcher concluded with major results, including: The Kingdom's great care and interest in the environment, and the considerations given to it as a top priority, within the Kingdom's Vision 2030. The diversity of those efforts to include all forms and elements of the environment, locally, regionally, and internationally, emphasized through the main pillars: administrative, legal, financial and security, to ensure sustainability and potency. The most prominent recommendations were to establish programs to qualify and train those interested in working in the environmental field, and to establish a national platform to document the Kingdom's efforts in the environmental field, and to facilitate the work of the researchers.
