طبيعة المسؤولية الجنائية للفصامي في القضاء السعودي / The Nature of Schizophrenic Criminal Liability in Saudi Jurisdiction

   تناول هذا البحث طبيعة المسؤولية الجنائي للفصامي في القضاء السعودي، حيث حاول استكشاف مدى صحة الفرضية القضائية والفقهية التي تقول بأن الفصام لا يعدم المسؤولية الجنائية بل ينتقص منها. وقد توصل البحث عبر دراسة الجوانب الطبية المختبرة إلى عدم صحة تلك الفرضية، حيث ثبت أن مرض الفصام يؤدي إلى حجب التمييز والإرادة عند المريض مما يتطلب تغيير التوجهات القضائية التي تعتبره عنصراً مخففا للعقاب فقط. كما توصل البحث إلى أن الأحكام الشرعية الإسلامية قبل ألف وأربعمائة عام قد أخذت بذات النتيجة التي توصل إليها العلم اليوم. وانتهج البحث المنهج الوصفي والتحليلي والمقارن من حيث الموضوع؛ إذ انقسم البحث إلى فصلين؛ تم تخصيص أولهما لدراسة الشق الطبي، والآخر للشق القانوني حيث تمت دراسة الأدبيات التاريخية والحديثة لمرض الفصام، وأنواع الفصام وتشخيصه طبياً وأيضاً من ناحية التشخيص العدلي. في حين تمت دراسة المسؤولية الجنائية للفصامي في الفصل الثاني والتي تضمنت، مفهوم المسؤولية الجنائية، ثم المسؤولية الجنائية للفصامي في قوانين مجلس التعاون الخليجي والقانون المصري، وكذلك اشتمل هذا الفصل على دراسة موقف القضاء السعودي من المسؤولية الجنائية للفصامي وموقف الشريعة الإسلامية في هذا الصدد. أما من حيث الشكل والضبط والتوثيق فقد أخذ البحث بمنهج شيكاغو باعتباره الأنسب لهذه الدراسة القانونية المتعمقة.

   This research deals with the nature of the criminal responsibility of the schizophrenic in the Saudi judiciary, as it tries to explore the validity of the juridical and jurisprudential hypothesis, which says that schizophrenia does not exclude criminal responsibility, but rather detracts from it. The research concluded by examining the tested medical aspects that this hypothesis was not correct, as it was proven that schizophrenia leads to obscuring the patient's discrimination and will, which requires changing judicial approaches that consider it an element that mitigate punishment only. The research also concluded that the Islamic legal rulings one thousand and four hundred years ago took the same conclusion reached by science today. The research followed the descriptive, analytical and comparative approach in terms of subject matter. As the research was divided into two chapters; The first of them was dedicated to the study of the medical part, and the other to the legal part, where the historical and modern literature on schizophrenia, types of schizophrenia and its medical diagnosis were studied, as well as in terms of forensic diagnosis. While the criminal responsibility of the schizophrenic was studied in the second chapter, which included the concept of criminal responsibility, then the criminal responsibility of the schizophrenic in the laws of the Gulf Cooperation Council and Egyptian law. Islam in this regard. In terms of form, control and documentation, the research took the Chicago methodology as the most appropriate for this in-depth legal study
