الشيك وجرائمه في نظام الأوراق التجارية السعودي | Check crimes in the Saudi commercial papers law

يهدف البحث إلى بيان أهميته كون الأنظمة السعودية لم تتطرق لهذا الموضوع سوى في نظام الأوراق التجارية السعودي الصادر عام 1383ه مقارنة ببعض القوانيين الأخرى في بعض الدول، والتي نصت على عقوبة الإخلال بالوفاء بالشيك، نظراً للظروف الاقتصادية والاجتماعية وتطور الحياة التي فرضت تغيراً في التعامل بالشيك وأصبح الحديث عنه ضرورة قانونية لا بد أن يناقشها الباحثون ورجال القانون للحفاظ على مستقبل هذه الورقة التجارية وحمايتها بضمانات قانونية، نظراً لكثرة التعاملات بالشيك في الحياة العملية والمصرفية والتي جعلت الشيك يشكل خطراً على المتعاملين به، لأنه أصبح محلاً للعديد من الجرائم التي توصف بجرائم الشيك، ومنها الجرائم المرتبطة بالرصيد مثل إصدار شيك دون أن يكون له رصيد، أو وجود رصيد لكنه غير كاف لمبلغ الشيك، والتي تُعد جرائم عمدية يتطلب فيها توافر القصد الجنائي، لذا نجد المنظم السعودي خص الشيك دون غيره من الأوراق التجارية بالحماية الجنائية.
لذا تناول هذا البحث التعريف بالشيك ووظائفه وشروطه، مروراً بصور الجرائم الواقعة عليه إلى الآثار المترتبة على ارتكاب جرائم الشيك، والعقوبات المقررة على تلك الجرائم، وأنهينا البحث ببيان النتائج التي ظهرت واضحة والتوصيات المهمة.

Abstract:
  The research aims to demonstrate its importance since the Saudi regulations did not address this issue except in the Saudi Commercial Papers Law issued in 1383 AH compared to some other laws in some countries.
The Saudi regulations stipulated the penalty for breaching the payment of the check, because of the change of the economic and social conditions and the development of life that imposed a change in dealing with the check.
Talking about this issue became a necessity that researchers and jurists must discuss in order to preserve the future of this commercial paper and protect it with legal guarantees.
Due to the large number of check transactions in practical and banking life, which made the check a danger to its dealers, because it has become the subject of many crimes that are described as check crimes, including crimes related to the balance such as issuing a Dishonored check, or having a balance but it is insufficient for the amount of the check, which are considered intentional crimes in which criminal intent is required. Therefore, we find that the Saudi regulator singled out the check, excluding other commercial papers, with criminal protection.
Therefore, this research dealt with the definition of the check, its functions and conditions, passing through the images of the crimes committed against it to the effects of committing check crimes, and the penalties prescribed for those crimes, ending the research by stating the results that appeared clearly and the important recommendations.
