المستخلص

تنوعت الخدمات المقدمة من البنوک لعملائها بالآونة الأخيرة، ويسعى العملاء للحصول على خدمات بنکية متنوعة بحسبان البنوک أشخاصاً معنوية مهنية محترفة، ويعجز العملاء عن تحقيق النتائج التي تقدمها البنوک لهم من جراء تلک الخدمات في شتى المجالات البنکية، والأغراض التجارية، بغية تعزيز أرباح العملاء وتسهيل أعمالهم، وتتعدد الخدمات البنکية ما بين فتح حسابات وتلقى ودائع وتقديم إئتمانات وإقراض، وغيرها من الخدمات المتنوعة.
ومع تسارع وتيرة التکنولوجيا، تواکبت أدوات الخدمات البنکية مع الجوانب التطبيقية للثورة التکنولوجيا لاسيما في إطار الخدمات التي تقدمها البنوک للعملاء، وتعد خدمة التحويلات الإلکترونية البنکية من حساب عميل إلى حساب مستفيد من الخدمات البنکية الهامة المستحدثة لاسيما مع ظهور الکمبيوتر والإنترنت في الربع الأخير من القرن الماضي وإزدياد نشاطاته والتي شملت التحويلات الإلکترونية بمعرفة البنوک، ومع تشابک تلک العملية وتعدد أطرافها سواء تمثل في العميل أو البنک، أو مزود الخدمة والمصمم لآلية تنفيذها، فلذلک لزم تحديد معالم التحويلات الإلکترونية البنکية وضمها في مفردات تشريعية واضحة المعالم ومنظمة المعايير لضمان الإستفادة المثلى منها، مع ملاحظة أن هناک ضماناً مجرداً في هذا الشأن حيث لا تؤثر علاقة ما نشأت ما بين طرفين على باقي العلاقات التي ترتبط بالأطراف الأخرى تکريساً لأهمية هذه العملية، ولتشجيع إقبال العملاء عليها بغية تحقيق البنوک لمکاسب عن الرسوم والمصاريف المدفوعة لقاء خدمة التحويلات الإلکترونية البنکية، وهناک إلتزامات بضمانات قانونية تنشأ من جراء هذه العملية، وعلاقات تتشابک أطرافها إبان تنفيذ هذه الخدمة، وبالطبع هناک مسئولية تترتب على عدم نجاح وإکتمال الخدمة، مع ترتب ضرر من جراء عدم إکتمالها، مما يلزم تحليل مفردات وآليات سريان خدمة التحويلات الإلکترونية البنکية على نحو دقيق لإيضاح طبيعتها القانونية وتأصيلها.

Abstract:
  The services provided by banks to their clients have recently varied, and clients seek to obtain a variety of banking services as banks consider them professional, legal persons, and clients are unable to achieve the results offered by banks to them as a result of these services in various banking fields and commercial purposes, in order to enhance clients’ profits and facilitate their business. Banking services vary between opening accounts, receiving deposits, providing credits and lending, and other miscellaneous services. With the acceleration of technology, banking services tools have coincided with the applied aspects of the technology revolution, especially in the context of the services provided by banks to customers. And the increase in its activities, which included electronic transfers by banks, and with the intertwining of that process and its multiplicity of parties, whether represented by the customer or the bank, or the service provider and the designer of the mechanism for its implementation. Note that there is an abstract guarantee in this regard, as the relationship that has arisen between two parties does not affect the rest of the relationships that are connected with the other parties in order to devote the importance of this process, and to encourage customer demand for it in order for the banks to achieve profits on the fees and expenses paid in exchange for the electronic bank transfers service, and there are obligations with guarantees Legal issues arising from this process, and intertwined relations during the implementation of this process For a service, and of course there is a responsibility that results from the lack of success and completion of the service, with damage resulting from its incompleteness, which requires an accurate analysis of the vocabulary and mechanisms of the operation of the electronic bank transfer service to clarify its legal nature and its rooting.
