الهدف من البحث: نهدف من هذا البحث النظر في التمييز بين الاستخدام السلمي وغير السلمي أي العسکري للفضاء الخارجي في القانون الدولي. وبعد ذلک سوف نبدأ بطرح المراحل الرئيسية لسباق الفضاء الخارجي واستخدامه لأغراض عسکرية وماهي مشروعية إستخدام القوة المسلحة في الفضاء الخارجي ثم نختتم البحث بقابلية تطبيق قواعد القانون الدولي الإنساني على النزعات المسلحة في الفضاء الخارجي.
وعموما، الخوض في قانون الفضاء يستتبع بالضرورة الإلمام والإطلاع على المعلومات الکافية عن التقنيات الفضائية بالحد الذي يسمح بفهم أبعاد الأنشطة المختلفة للدول سواء کانت ذات طابع سلمي أو عسکري وما يمکن أن تؤول إليه في المستقبل.
منهجية البحث: يتبع الباحث في هذه الدراسة خليطا بين المنهج التحليلي والمنهج الوصفي. وذلک بتحليل نصوص المعاهدات الدولية المتعلقة بالفضاء وکذلک القانون الدولي العام والقانون الدولي الإنساني. علاوة على ذلک لجأ الباحث إلى المنهج الوصفي کمنهج مساعد، حيث إقتضت الدراسة في بعض مراحلها أن أستعين بالوصف بإعتباره عامل مساعد لا غنى عنه في عملية التحليل.
 
Abstract:
Research Goal: The aim of this research is to consider the distinction between the peaceful and non-peaceful use of outer space, i.e. military, in international law. We will then begin by raising the key stages of the outer space race and its use for military purposes and the legality of the use of armed force in outer space and conclude by examining the applicability of the rules of international humanitarian law to armed conflicts in outer space.
In general, delving into space law necessarily entails familiarity with and access to adequate information on space techniques to the extent that the dimensions of the various activities of States, whether peaceful or military in nature, can be understood and can be reached in the future.
Research methodology: In this study, the researcher uses a combination of analytical and descriptive approaches. By analyzing the texts of international space treaties as well as general international law and international humanitarian law. Moreover, the researcher used the descriptive method as an auxiliary method. At some stages of the study, descriptions were required to assist in the analysis process.
